1 Acceptance of Terms

By downloading, installing, activating, or using My Content Tools ("the Application," "MCT," or "the Software"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not install or use the Application.

These Terms constitute a binding legal agreement between you and My Content Tools ("Company," "we," "us," or "our"). Your continued use of the Application constitutes ongoing acceptance of these Terms as updated from time to time.

2 Description of Service

My Content Tools is a desktop application for macOS designed to assist professional content creators and studio operators with:

• Performer management and compliance record-keeping (2257 documentation, release forms, ID verification)
• Revenue tracking across multiple platforms (Clips4Sale, ManyVids, OnlyFans, and others)
• Expense tracking and financial reporting
• Shoot scheduling and production management
• AI-assisted content description and social media generation
• Custom order and client management

3 License & Permitted Use

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on devices you own or control, solely for your personal or internal business purposes.

You may not:

• Copy, distribute, sell, sublicense, or transfer the Application or your license key to any third party
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
• Remove or alter any proprietary notices or labels on the Application
• Use the Application to build a competing product or service
• Share a single license key across multiple studios or business entities under different ownership

4 Age & Eligibility Requirements

By using the Application, you represent and warrant that:

• You are at least 18 years of age
• You are operating a lawful business in compliance with all applicable laws in your jurisdiction
• All performers whose information you record in the Application are adults who have provided valid government-issued photo identification verifying their age
• You maintain, or will maintain, all required compliance documentation (including 18 U.S.C. § 2257 records or equivalent local law requirements) independently of the Application

The Application is a record-keeping aid only. It does not constitute legal compliance advice. You are solely responsible for ensuring your business complies with all applicable laws, including age verification and record-keeping requirements.

5 Your Content & Data

You retain full ownership of all data, documents, images, and records you input into or store through the Application ("Your Content"). We do not claim any ownership rights over Your Content.

Your responsibilities include:

• Maintaining regular backups of your data (the Application includes an optional cloud backup feature)
• Securing access to the device on which the Application is installed
• Complying with all applicable data protection and privacy laws with respect to personal information of performers and clients stored in the Application
• Obtaining all necessary consents from performers and clients whose information you store

We are not liable for any loss, corruption, or unauthorized access to Your Content.

6 Payment, Refunds & Billing

The Application is sold as a one-time purchase or subscription, as described on our pricing page. Purchases are processed through LemonSqueezy, a third-party payment processor. By making a purchase, you also agree to LemonSqueezy's terms of service.

License Keys: Upon successful payment, you will receive a license key by email. This key is personal to you and may not be shared or transferred. Keep your license key in a safe place — it is required to activate the Application on new devices.

Refund Policy:

• We offer a 7-day money-back guarantee from the date of purchase for first-time customers who have not previously received a refund
• Refund requests must be submitted to support@mycontenttools.com within 7 days of purchase with your order number
• Refunds are not available after 7 days, for license keys that have been used on more than one device, or for renewals

7 Prohibited Uses

You agree not to use the Application to:

• Record, store, or process information relating to any individual under the age of 18
• Facilitate, promote, or engage in human trafficking, non-consensual content, or any illegal sexual activity
• Store fraudulent, falsified, or forged identification documents
• Engage in fraud, money laundering, or any other unlawful financial activity
• Violate any applicable local, state, national, or international law or regulation
• Infringe the intellectual property rights of any third party
• Transmit viruses, malware, or any other harmful code through connected features (e.g., email integrations)

Violation of these prohibitions may result in immediate termination of your license without refund and may be reported to appropriate authorities.

8 Intellectual Property

The Application, including its design, code, AI models, UI elements, and documentation, is the exclusive property of My Content Tools and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.

The "My Content Tools" name, logo, and related marks are trademarks of My Content Tools. You may not use these marks without our prior written consent.

9 Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.

We do not warrant that:

• The Application will meet all your requirements
• The Application will be error-free, secure, or available at all times
• Any AI-generated content produced by the Application is accurate, appropriate, or legally compliant for your use case
• The Application constitutes legal, financial, or compliance advice of any kind

10 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY CONTENT TOOLS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from regulatory actions, compliance failures, or legal proceedings
• Damages resulting from loss or corruption of data stored in the Application

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APPLICATION SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11 Indemnification

You agree to indemnify, defend, and hold harmless My Content Tools and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Application
• Your violation of these Terms
• Your violation of any third-party rights
• Your failure to maintain required legal compliance records
• Any content stored in the Application by you or on your behalf

12 Termination

We may terminate or suspend your license immediately, without notice or liability, if you breach these Terms. Upon termination, your right to use the Application ceases immediately. Your data remains on your local device and is not deleted by us.

You may terminate your license at any time by ceasing use of the Application and deleting it from your device. Termination does not entitle you to a refund except as expressly provided in Section 6.

13 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Florida for the resolution of any disputes arising under these Terms.

If you are located outside the United States, you agree to comply with all local laws and regulations regarding the use of software and online services.

14 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where possible, notify you via the Application or email.

Your continued use of the Application after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Application.
